Terms and conditions

  1. Definitions

    1.1 In these general terms and conditions, hereinafter to be referred to as: “General Terms and Conditions”, the following is meant with these terms:
    1.2 “Participant”: the natural person using the services of CRUYFF FOOTBALL in the capacity of participant and in concordance with the Agreement between the company and the Contractor.
    1.3 “Registration form”: the form that is part of the internet website “www.cruyfffootball.com” of CRUYFF FOOTBALL.
    1.4 “Contractor”: the natural person or legal entity entering into the Agreement with CRUYFF FOOTBALL.
    1.5 “Agreement”: an agreement between CRUYFF FOOTBALL and the Contractor regarding one or more services to be rendered by CRUYFF FOOTBALL to the Contractor and the Participant.
    1.6 “Participation costs”: the total amount to be paid for the services to be rendered by CRUYFF FOOTBALL regarding the agreement that was closed with the Contractor, inclusive of VAT.
    1.7 “CRUYFF FOOTBALL”: Team Jonk Football Development BV, having its offices in Volendam (NL).

  2. Applicability

    2.1 The current General Terms and Conditions apply to all offers, project confirmations and any agreements stemming from them or connected to them, or further agreements regarding the “CRUYFF FOOTBALL”, provided by CRUYFF FOOTBALL.
    2.2 The applicability of any general (or specific) conditions or terms of the Contractor is expressly denied by CRUYFF FOOTBALL
    2.3 Deviations from or additions to, in whichever form, the Agreement or the General Terms and Conditions are only valid in case CRUYFF FOOTBALL has agreed to them in writing.
    2.4 In case of any discrepancy between the provisions in the General Terms and Conditions and/or provisions from the Agreement, the latter prevail.
    2.5 In case any provision in these General Terms and Conditions is not applicable or contrary to the Public Order or the Law, only the provision in question will be considered unwritten and the remaining General Terms and Conditions will remain in force completely.

  3. Creation of the Agreement

    3.1 All offers by CRUYFF FOOTBALL are free of obligation and subject to the available capacity, unless it is specifically agreed upon otherwise.
    3.2 The Agreement is created after the Contractor has filled in the registration form via the website, has checked the General Terms and Conditions and has sent the form.
    3.3 In case of registration via the internet, there will be a period of reflection of 2 days regarding the remote purchase. Within that period of time, the registration may be cancelled, free of charge and without a provision of reasons, provided that it is effectuated in writing.

  4. Payment

    4.1 Payment via iDEAL
    CRUYFF FOOTBALL offers the possibility of payment via iDEAL (only possible for payments from within the Netherlands). With this method of payment, you can process the payment directly with your own bank during the registration process. You make the payment within your familiar internet payment environment, based on the specific security methods of your own bank. If you use internet banking, you can use iDEAL without having to register for it.
    4.2 Credit Card payments
    CRUYFF FOOTBALL offers the possibility of paying via credit card (Visa or MasterCard). In case of payment via credit card, additional charges will be made. The additional charges are 5% of the total amount, with a minimum of €5 extra and a maximum of €15.
    4.3 If and insofar as timely payment is not carried out, the Contractor will be legally in default, without any notice of default being required.
    4.4 In case of untimely payment, CRUYFF FOOTBALL reserves the right to cancel the Agreement, and the Contractor will be liable for payment of the cancellation costs, in concordance with the provisions in Article 8, paragraph 2 of the General Terms and Conditions.

  5. Instructions and code of conduct

    5.1 The Participant is under obligation to observe all reasonable instructions by CRUYFF FOOTBALL that are conducive to the proper performance of the Agreement. Also, the Participant must respect the code of conduct that CRUYFF FOOTBALL wishes to be observed during the stay at the accommodations based on the Agreement.
    5.2 Any participant that causes hindrance or nuisance or may do so, as a result of which the proper performance of the Agreement by CRUYFF FOOTBALL is made difficult to a severe extent, may be excluded from (the continuation of) participation by CRUYFF FOOTBALL. All costs and damages caused by this will be at the expense of the Participant.

  6. Liability of CRUYFF FOOTBALL

    6.1 All baggage and other personal belongings will remain at the risk of the Participant at all times. CRUYFF FOOTBALL does not accept any liability – with the exception of damages caused by intent or gross negligence on the part of CRUYFF FOOTBALL – for damages to (valuable) items, baggage and other personal belongings of the Participant, regardless of whether they were put in the custody of the staff of CRUYFF FOOTBALL, as a result of theft, loss or damage.
    6.2 CRUYFF FOOTBALL does not accept any liability for damages for which a reimbursement claim exists based on a travel or accident insurance or based on (liability) insurances of third parties that are involved in the performance of the Agreement by CRUYFF FOOTBALL.
    6.3 With due regard to the provisions in the preceding paragraph of this article, all liability of CRUYFF FOOTBALL is limited to the amount any claim is based on in the case in question, based on its (liability) insurance(s).

  7. Liability of Contractor

    7.1 The Contractor is jointly and severally liable for all damages that is/will be created for CRUYFF FOOTBALL and/or any third party as a direct or indirect consequence of an accountable shortcoming – such including failure to observe the code of conduct below – by the Participant.
    7.2 The Contractor will exempt CRUYFF FOOTBALL from any damages liability claims by third parties stemming from or connected to the use by the Participant of the facilities and/or services in concordance with the Agreement.

  8. Force Majeure/ Amendment/ Cancellation CRUYFF FOOTBALL

    8.1 If CRUYFF FOOTBALL is partly or wholly prevented by force majeure from carrying out one or more obligations stemming from the Agreement, CRUYFF FOOTBALL is authorized to offer an alternative that is equal in value in her opinion, or to have the Agreement partly or wholly cancelled, without any judicial interference, without being liable for any payment of damages vis-à-vis the Contractor.
    8.2 Force majeure, as referred to in paragraph 1 of this article, includes insufficient registrations for participation in an event. This is the case if the number of registrations amounts to less than 50% of the maximum number of participants per event.

  9. Cancellation by the Contractor

    9.1 Cancellation must take place in writing, in which correspondence the date of the postmark will serve as the indicative date for the provisions in paragraph 2 of this article.
    9.2 Cancellation within14 days before the event may only take place in case of one of the following reasons: illness, injury or severe calamities. In case of illness or injury, a medical attestation must be provided to CRUYFF FOOTBALL.
    9.3 Other reasons for cancellation may only be presented up to 14 days before the event, such including the involved administration and cancellation costs.
    9.4 In case of cancellation of the Agreement for a Workshop, the following amount will be charged per Participant:
    – 25% of the registration fee in administrative and cancellation costs, in case the cancellation is received at least 14 days prior to the event.
    – 50% of the registration fee in administrative and cancellation costs, in case the cancellation is received at least 7 days prior to the event.
    – 100% of the registration fee in administrative and cancellation costs, in case the cancellation is received in writing or by phone up to the day before the event.
    9.5 In case of cancellation of the Agreement for a Course, the following amount will be charged per Participant:
    – €12,50 administrative and cancellation costs, in case a cancellation due to injury is received.
    – €12,50 administrative and cancellation costs, in case the cancellation is received up to 6 weeks prior to the event.
    – 25% of the registration fee in administrative and cancellation costs, in case the cancellation is received at least 6 weeks prior to the event.
    – 50% of the registration fee in administrative and cancellation costs, in case the cancellation is received at least 14 days prior to the event.
    – 75% of the registration fee in administrative and cancellation costs, in case the cancellation is received at least 7 days prior to the event.
    – 100% of the registration fee in administrative and cancellation costs, in case the cancellation is received in writing or by phone up to the day before the event.

  10. Lost and found

    10.1 Lost and found items will be kept by CRUYFF FOOTBALL for three days after the event has ended. After the expiration of that term, CRUYFF FOOTBALL is authorized to transfer these items to a charity organization of its own choice.

  11. Applicable law and disputes

    11.1 Dutch law solely applies to the Agreement and all agreements stemming from it.
    11.2 All disputes that may arise between the parties in connection with the Agreement or any agreements stemming from it will be settled by the competent bench at the court of Amsterdam (NL).

  12. Other stipulations

    12.1 Any audio-visual material of the activities of CRUYFF FOOTBALL and its participants that is recorded on the premises and at various locations may be used by CRUYFF FOOTBALL in its communication means for the promotion of CRUYFF FOOTBALL.
